BIKE VS. MOTOR VEHICLE:
Accident Benefits for Windsor Cyclists
Cyclists in Windsor who are struck by motor vehicles may be entitled to no-fault Accident Benefits, in addition to filing a lawsuit against the at-fault driver. This is important information, especially for cyclists who do not have automobile insurance and may not realize they still qualify for coverage.
Accident Benefits can provide essential support, including immediate and long-term funding for medical care, rehabilitation, income replacement, and attendant care.
The first step is to determine which insurance company is responsible. If you have auto insurance, or are covered under a spouse’s or parent’s policy, that insurer will handle the claim. If not, the benefits are provided through the insurance company of the driver involved in the crash.
In situations where no one involved has insurance, cyclists can apply to Ontario’s Motor Vehicle Accident Claims Fund (MVACF). This applies frequently in hit-and-run cases, which we regularly assist with.
